On the road again

In an hour and a half or so, I'm going to get in the rental car with Graham and Celosa and we will go to the ranch. This means that we'll go the same route that ended in the wreck. I anticipate drastically different results, this time, but it doesn't mean I'm not nervous about it.

I think once I do it, I'll feel better about the whole thing. I've driven it hundreds of times before. I know the accident was a fluke. I know that we'll be ok, we'll be much more careful than we've ever been before.

And we need to go to the ranch. We haven't been there since we got engaged, and we have planning to do that requires us to look at the terrain before we can make some decisions.

But yuck.

In other news, we went to the doctor on Wednesday. I got some more pain killers because my elbow still smarts, and Graham got some muscle relaxers because his neck is still tense. But we're mending. It still hurts sometimes, but it's not nearly as black and blue and the scabbing has subsided. Still, I pulled a sliver of glass out of my arm on Wednesday night. I expect there are probably still a few in there at various points. My neck hurt when I woke up this morning.

I also met with the other driver's insurance adjuster on Thursday. She gave me forms to fill out, and she seemed nice enough. She encouraged me to be as specific and as broad as possible when describing what the accident has meant to my daily life. I probably didn't put enough down there, though I suppose I can supplement later.

I think we're in pretty good shape, because he still hasn't contacted his own insurance or given a statement yet. Maybe he doesn't know how insurance works? Maybe he is afraid to admit what happened? I know I filed a claim as soon as I got home from the hosptial the day of the accident. And I got in touch with the other insurance company as soon as I was able. I don't think he looks good at this point, but then I'm not an adjuster. I did find out, using the citation information in the accident report, that he has a court date for his $270 ticket on June 1. I don't know if we should be there or not, but the police put the wrong phone number down for my contact information. I'm thinking we may end up contacting them, in case we need to testify.

We still have bills and such coming in. It'll take awhile to sort through all of our receipts and figure out all the paper work that needs to be filed. I think we can file with both companies and let them sort out who pays what. I need to get pay stubs and time missed and all that sort of stuff from my own HR department.

I have no idea what ultimately we'll end up with. It is strange to be in this position.

they way it works is thus: liability sounds pretty clear - he's probably 100% at fault. So his carrier will be trying to get a statement from him. If he doesn't cooperate, they *may* exercise their right to deny his claim for non-cooperation. If that happens, your policy will pay as uninsured motorist. Most carriers don't penalize the third party if the insured refuses to cooperate, though - they may not pay his own car damage, but they'd probably honor your claim, especially if they get enough information from witnesses, etc., to show what happened and it's clear he's liable. Either way if you have medpay or PIP - I can't remember which is on Texas policies - your insurance should pick up whatever you are out of pocket after your health insurance pays. They will be subrogated on your recovery from the other carrier.

We have PIP. USAA has been great, and they suggested submitting receipts to both carriers, just to be on the safe side.

The Farmers person has already started the claims process with us, so I don't think that they'll go the non-cooperation route.

well, altho it goes without saying, ima say it anyway - if you have any questions at all or you run into problems, please let me know. I may be able to (unoffically) give you advice and it's likely I know folks at both carriers. :)
